Into the Operating Room

The last two weeks pushed clinical AI into higher-stakes territory than the back-office documentation where it made its name. It showed up in the operating room and in the diagnosis itself, even as the FDA that referees all of it kept losing the people in charge.

Start with the robots, which suddenly have company. Johnson & Johnson won FDA de novo authorization for its Ottava surgical system across ten general-surgery procedures, making it the second heavyweight challenger to Intuitive's da Vinci after Medtronic's Hugo, with a pack of smaller entrants like CMR Surgical and Distalmotion close behind. Ottava is the first soft-tissue system to build the robotic arms into the operating table, and it cleared about six months after filing, a quick turn for a de novo. Analysts still expect a slow, training-heavy rollout against Intuitive's installed base, but as J&J's surgery chief put it, "what defined the last 25 years of surgery will not define the next 25."

The robots are also starting to watch themselves. Medtronic unveiled Touch Surgery Aide, its first FDA-cleared real-time AI for robotic surgery, an Nvidia-based platform whose debut application alerts the surgeon when an instrument slips out of the camera's view. It runs on the Touch Surgery ecosystem already in more than 1,500 operating rooms and is built to run several AI tools at once during a live procedure.

Then there is the frontier that makes regulators nervous: AI that writes the diagnosis. Aidoc explained why it is taking a generative AI tool called First Read through the FDA's breakthrough pathway, a system that detects more than 100 conditions on chest X-rays and drafts the full report for a radiologist to sign. It is one of the first end-to-end generative diagnostics headed toward clearance, and the company leans on continuous human oversight as its main guard against automation bias. That caution reflects a vacuum: the FDA has held two advisory panels on generative AI but still has not finalized a framework for it.

Quieter than any of that, one already-cleared tool went to the bedside. LifeBridge Health's Sinai Hospital in Baltimore put Prenosis' Sepsis ImmunoScore into clinical use, the first FDA-authorized AI diagnostic for sepsis, cleared through the De Novo pathway in 2024. It reads 22 parameters to flag sepsis risk within 24 hours and lives inside the EHR like a lab test. Sinai has run it on about 75 patients over six weeks and is tracking bundle compliance and length of stay as it weighs a system-wide rollout.

In case you missed it: AI keeps rewriting the economics of drug discovery, at least before human testing starts. A TD Cowen survey of 80 biopharma leaders found AI compressing preclinical costs and timelines by as much as 70%, enough to create "more shots on goal," though the sobering counterweight is that no AI-discovered drug has yet won FDA approval. And the wearables-go-clinical push claimed a notable hire: Whoop named Ami Bhatt, the sitting chair of the FDA's first digital health advisory committee, as its chief medical officer, a move that pulls a top AI-device adviser into industry and leaves the FDA panel that vets generative AI without a chair.

Reshuffling Who Gets Paid

Washington spent the fortnight deciding who gets paid and who doesn't. A Medicare pay redesign tilted dollars around, blue-state Medicaid money got frozen, and the courts and the AI-prior-auth fight ran in the background.

Start with doctors. CMS's proposed 2027 physician fee schedule would tilt Medicare dollars toward primary care and hand physicians an overall cut of as much as 1.68%, mostly because the temporary 2.5% bump Congress gave them for 2026 expires. Specialists take the sharper hit: the rule would pay only half for the cheaper of a same-day procedure and office visit, and it reworks how practice expenses are calculated. The bigger tell is a request for comment on scrapping the AMA-run committee (the RUC) that has valued Medicare services for decades, which critics say overpays procedures relative to primary care.

The administration also froze money it says it's owed answers on. CMS deferred about $867.5 million in Medicaid payments to California and $199 million to Minnesota, citing unsupported claims for in-home care, and said it would expand its power to bar bad actors from federal programs. It is the latest in a run of freezes aimed at Democratic-led states, coming after a $1.3 billion California deferral in May. The states can recover the funds by documenting the claims.

On the Hill, the House Energy and Commerce Committee advanced a stack of health-cost bills, led by the Lower Costs, More Transparency Act, which passed 45-0 and would codify hospital and insurer price-posting rules and extend them to labs and imaging. A prior-authorization transparency measure moved alongside it, while a "Prices on the Wall" bill drew a closer vote. The package now heads to the full House.

The courts, meanwhile, pushed back on coverage cuts. Three days before the rules were set to take effect, a Maryland judge stayed eight provisions of the CMS marketplace overhaul, siding with a coalition of cities that includes Baltimore and Columbus, Ohio. The judge found the plaintiffs likely to win and pointed to irreparable harm from changes CMS itself projected could cost up to 2 million people their coverage.

In case you missed it: The FDA's top job may stay empty for a while. More than two months after Marty Makary resigned, the White House still hasn't named a nominee, and analysts say a narrow Senate calendar and the midterms could leave acting chief Kyle Diamantas in place for months, leaving user-fee reauthorization and the agency's generative-AI framework in limbo. And the Senate preserved the administration's AI prior-authorization experiment, voting 46-50 along party lines to keep the WISeR pilot alive in six states, though a House spending-bill amendment could still choke off its funding.

Bruised but Still Buying

Earnings season showed policy landing hard on health-company balance sheets. Capital kept flowing anyway, into IPOs, deals, and AI bets.

Policy showed up in the numbers first. ACA and Medicaid changes drove membership and profit hits across insurers and hospitals: Elevance's enrollment fell 469,000 as it exited the D.C. Medicaid program and flagged more exits ahead, while UnitedHealthcare shed 525,000 members to Medicaid work requirements. Hospital giant HCA now expects the ACA disruption to cost it $1 billion to $1.2 billion this year. The through-line is a coverage rollback moving straight into corporate income statements.

The GLP-1 rivalry went to court. Novo Nordisk sued Eli Lilly over what it calls deceptive ads, arguing Lilly pits the highest doses of Zepbound and Mounjaro against outdated, lower doses of Wegovy and Ozempic. Novo wants an injunction and a corrective campaign, noting there's no head-to-head trial of the two drugs' top doses since its stronger 7.2-milligram Wegovy launched in March. Lilly says its ads rest on its own head-to-head trial and are "truthful." Zepbound booked $4 billion in the first quarter to Wegovy's $2.7 billion.

The IPO window cracked open wider. Gene-editing startup Scribe Therapeutics raised about $129 million in the first CRISPR IPO in more than two years, pricing at the top of its range as the 14th biotech to go public in 2026. Its lead program uses in-vivo editing to lower cholesterol by silencing the PCSK9 gene. Six more biotechs have signaled plans to list in the weeks ahead.

Medtronic kept spending. It closed a $650 million deal for SPR Therapeutics, adding a temporary peripheral-nerve-stimulation device cleared for 60 days of pain treatment and pushing further into neuromodulation, a market its CFO says is growing more than 20% a year. It's part of a stated return to offense that also brought in CathWorks and Scientia Vascular this year.

And the incumbents are racing to own the AI front door. CVS detailed Health100, a consumer AI assistant built on Google Cloud that ties together a patient's prescriptions and benefits across its pharmacy and insurance arms. CEO David Joyner spent 18 months rebuilding the plumbing and credits federal interoperability rules for making it possible, as CVS races Amazon and OpenAI to become the industry's default health agent.

Resmed agreed to sell its MatrixCare post-acute software unit to Frazier Healthcare Partners for $490 million, a discount to the $750 million it paid in 2018, as it refocuses on sleep and breathing. And the EHR giant faces a leadership shakeup, with Epic president Sumit Rana stepping down August 14 after nearly 30 years, removing the person many viewed as eventual successor to 82-year-old founder Judy Faulkner at a company that still controls about 44% of the acute-care EHR market.
